Are safeguards for Free Prior and Informed Consent supporting local land struggles in our region?

International safeguards that were developed to govern resource investments often involve a requirement for free, prior and informed consent (FPIC) from affected communities. But what opportunities and constraints do local actors face in using FPIC provisions to defend their customary land rights? Drawing on cases from Cambodia, Indonesia and Papua New Guinea, this new open access paper finds a mixed picture where FPIC implementation has at times been performative, while and at other times FPIC safeguards have been actively mobilised to protect local land rights. Some influential factors discussed in the paper include the reach and influence of local-civil society networks, who the investors are and the specific configuration of safeguards that apply to them (e.g. donors, private sector, states), as well as national policy & institutional frameworks.
